Common types of workplace accidents

From construction sites to office buildings, we handle every kind of New York workers' comp claim — and every parallel third-party case.

Falls from heights

Scaffold, ladder, and roof falls — both workers' comp and Labor Law § 240 absolute-liability claims against owners and GCs.

Slip-and-fall on the job

Wet floors, ice, and uneven surfaces causing falls in retail, restaurants, and healthcare workplaces.

Struck-by-object injuries

Falling tools, materials, and merchandise — covered by comp and often supporting Labor Law § 241(6) claims.

Common workplace injuries

The same body parts get hurt over and over again — and proper documentation is everything in a workers' comp claim.

Back & spine injuries

Herniated discs, lumbar strain, and spinal fractures — among the most common and most under-documented comp injuries.

Shoulder injuries

Rotator cuff tears, labral tears, and impingement requiring arthroscopic surgery and months of physical therapy.

Knee injuries

ACL and meniscus tears from twisting falls and kneeling work that often require surgical repair.

  • What does workers' compensation cover in New York?

New York workers' compensation provides wage-replacement benefits (typically two-thirds of your average weekly wage, subject to a cap), full medical care for the injury, prescription coverage, vocational rehabilitation, schedule loss-of-use awards for permanent impairment, and death benefits for surviving family. Workers' comp is a no-fault system — you do not need to prove your employer was negligent.

  • Can I see my own doctor?

You must generally choose a provider authorized by the New York Workers' Compensation Board, unless your employer has a Preferred Provider Organization in place during the first 30 days. After that, you can typically see any authorized provider of your choice. We help clients identify experienced workers' comp doctors who properly document the case.

  • What if my employer says I wasn't injured at work or denies my claim?

A denial or a controverted claim is not the end. The case proceeds to a hearing before a Workers' Compensation Law Judge where medical records, witness testimony, and expert reports can establish that the injury arose out of and in the course of employment. Many denied claims are won at the hearing or on review.

  • Can I sue my employer in addition to filing a comp claim?

Almost never. Workers' comp is generally the exclusive remedy against your direct employer. However, you can — and often should — file a third-party lawsuit against another negligent party (a property owner, a general contractor, a vehicle driver, a product manufacturer) for full damages including pain and suffering. We evaluate every comp case for a parallel third-party claim.

  • What if my workers' compensation claim is denied?

Promptly request a hearing and gather supporting medical and witness evidence. Most denied claims involve disputes about whether the injury is work-related, the extent of disability, or the average weekly wage. We represent injured workers at every level of the Workers' Compensation Board and on appeal to the Appellate Division when necessary.
