  • Does New York no-fault cover pedestrians hit by a car?

    Yes. If you were hit by an insured motor vehicle, the at-fault vehicle's no-fault insurance pays your medical bills and a portion of lost wages, regardless of fault, up to $50,000. You must file a no-fault application (NF-2) within 30 days of the accident to preserve these benefits, and you can also pursue a separate third-party claim for pain and suffering.

  • What if I was crossing outside a crosswalk or against the signal?

    You can still recover. New York follows pure comparative negligence — even if a jury finds you partially at fault, your damages are simply reduced by your percentage of fault rather than barred. Drivers also have a heightened duty to watch for pedestrians, especially in New York City under Vision Zero policies.

  • What if the driver fled the scene or was uninsured?

    You may be eligible for benefits through MVAIC (the Motor Vehicle Accident Indemnification Corporation) or through Uninsured/Underinsured Motorist coverage on a household auto policy. Both have early notice requirements — sometimes within 90 days — so contact a lawyer right away to preserve your rights.

  • What if I was hit by a city or MTA vehicle?

    Claims against the City, NYPD, FDNY, Department of Sanitation, the MTA, or other public agencies require a Notice of Claim within 90 days of the accident and a lawsuit within one year and 90 days. Miss those deadlines and the claim is usually lost. We routinely handle public-entity pedestrian claims and meet every notice requirement.

  • How long do I have to file a pedestrian accident claim in New York?

    For a third-party personal injury claim against a private driver, the statute of limitations is three years. Claims against public entities follow the 90-day Notice of Claim rule above.
