Social Security Disability Insurance (SSDI) is for workers who paid into Social Security long enough to qualify for benefits when a disability prevents them from working. Supplemental Security Income (SSI) is need-based, for disabled individuals with limited income and resources who may not have a sufficient work history. Many clients qualify for one, the other, or both.
You generally must have a medically determinable physical or mental impairment that has lasted, or is expected to last, at least 12 months — or to result in death — and that prevents you from performing substantial gainful activity. SSA evaluates work history, age, education, and residual functional capacity in a five-step sequential analysis. We build the medical record to fit each step.
Most initial SSDI and SSI claims are denied. Common reasons include incomplete medical records, missing functional capacity evidence, failure to follow treatment, work activity inconsistent with disability, and unclear onset dates. A denial is not the end — it is often just the start of a winnable appeal once the record is built out.
Reconsideration typically takes several months. A hearing before an Administrative Law Judge can take a year or more depending on the local hearing office. Appeals Council and federal court review add additional months. We move cases forward as efficiently as the agency allows and prepare clients thoroughly for each stage.
SSDI/SSI representation is regulated by federal law and handled on contingency. Fees are capped at 25 percent of past-due benefits, up to a statutory maximum set by SSA, and only paid if your claim succeeds. There are no upfront fees — if we don't win, you don't pay.
